1. Agreement

These Terms of Service ("Terms") govern your access to and use of foxtrotmercantile.com and any purchase you make from it (together, the "Site"). The Site is operated by Foxtrot Mercantile ("we," "us," "our").

By browsing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

Our Privacy Policy, Refund Policy, and Shipping Policy are incorporated into these Terms by reference and form part of your agreement with us.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering, you represent that you meet this requirement and that the payment method you use is yours or that you are authorized to use it.

3. Our products

We sell 3D-printed models and decorative wall art. Every item is printed to order.

Made-to-order variation. 3D-printed items are not injection-molded, and no two are identical. Visible layer lines, minor surface texture, small variations in color and finish between batches, and slight dimensional differences are normal characteristics of the process, not defects. Product photographs are representative; your item will resemble but not exactly match them.

Materials and use. Our items are decorative. They are made of thermoplastic and are not weatherproof, not flame-resistant, and not designed to bear weight or load. Do not leave them in direct sunlight, in a hot car, or near heat sources, as they may soften or warp. They are not for outdoor use.

Not aviation equipment. Nothing we sell is an aircraft part, a training aid, a certified instrument, or suitable for any aviation, structural, safety, or functional purpose of any kind.

Not a children's product. Our items are decorative collectibles intended for adults and older collectors. They are not toys, have not been designed or tested as children's products, and are not intended for children under 14. Thin or small parts may break and pose a choking hazard. Adult supervision is required if they are handled by children.

4. Orders

Placing an order is an offer to buy, not a completed sale. Our order confirmation email acknowledges receipt of your order; it is not acceptance. A contract is formed only when we ship your item.

We may refuse, cancel, or limit any order for any lawful reason, including suspected fraud, resale, quantity limits, errors, or requests we are not willing to produce. If we cancel an order you have already paid for, we will refund you in full.

Order accuracy is yours. Check your variant selection, quantity, and shipping address before checking out. Because we print to order, changes and cancellations are usually only possible before production begins.

5. Pricing and payment

All prices are in U.S. dollars and do not include shipping or applicable sales tax, which are calculated at checkout.

Prices and product availability may change at any time without notice. Despite our best efforts, listings occasionally contain errors in price or description. If an item's correct price is higher than the price shown, we will contact you before shipping to give you the choice of paying the correct price or cancelling for a full refund. We are not obligated to honor a pricing error.

Payment is processed by Shopify and its payment providers. We do not receive or store your full payment card details.

6. Custom and personalized orders

We accept custom requests through our contact page. Custom orders are subject to these additional terms:

You are responsible for what you ask us to make. By submitting a custom request, you represent and warrant that you own or have permission to use any design, text, image, name, logo, marking, or likeness you provide, and that producing it will not infringe anyone's intellectual property or other rights.

We may decline any request. We will not reproduce third-party logos, trademarks, insignia, copyrighted characters, military unit markings, or any content we consider unlawful or objectionable. We may decline a request at our discretion without giving a reason.

Approval. Where we provide a proof, mockup, or written description for your approval, your approval is final and production proceeds on that basis.

Final sale. Custom orders are final sale and cannot be returned or exchanged for change of mind. Our defect and damage guarantee still applies in full — see the Refund Policy.

Indemnity. You agree to indemnify and hold us harmless from any claim, damage, or cost, including reasonable legal fees, arising from a design or content you asked us to produce.

7. Shipping, title, and risk of loss

Shipping timeframes, carriers, and costs are described in our Shipping Policy. Delivery estimates are estimates, not guarantees.

Title and risk of loss pass to you upon delivery to the address you provided. Where a package is lost or damaged in transit, our Refund Policy sets out how we will make it right.

8. Returns

Returns, exchanges, damage claims, and refunds are governed entirely by our Refund Policy.

9. Intellectual property

Ours. The Site's design, text, product photography, graphics, and logos are owned by us or our licensors and are protected by copyright and trademark law. You may not copy, reproduce, scrape, resell, or create derivative works from them without our written permission.

Our physical products. Our items are sold for personal display and enjoyment. You may not reproduce, mold, cast, 3D-scan, reverse-engineer, or mass-produce them for commercial sale.

Third parties. Aircraft names, model designations, and manufacturer names referenced on the Site are the property of their respective owners and are used descriptively only. We are not affiliated with, endorsed by, or licensed by any aircraft manufacturer, airline, government agency, or armed service. See our Trademark & Intellectual Property Notice for details.

Notices. If you believe content on the Site infringes your rights, contact us at foxtrotmercantile@gmail.com with details and we will respond promptly.

10. Your submissions

If you send us feedback, ideas, reviews, photographs, or suggestions, you grant us a non-exclusive, royalty-free, worldwide licence to use them in connection with our business, including for marketing, without compensation or attribution. Do not send us anything you consider confidential. This does not apply to personal information, which is handled under our Privacy Policy.

11. Accounts

If you create an account, you are responsible for keeping your credentials secure and for activity under your account. Tell us promptly if you suspect unauthorized use. We may suspend or close an account that violates these Terms.

12. Acceptable use

You agree not to use the Site to break the law, infringe anyone's rights, transmit malware, scrape or harvest data, interfere with the Site's operation or security, place fraudulent orders, or impersonate anyone.

13. Marketing communications

If you sign up for our email list, you consent to receiving marketing emails from us. Every one includes an unsubscribe link, and you can opt out at any time. Transactional messages about orders you have placed are not marketing and will still be sent.

14. Third-party links and services

The Site relies on third-party services including Shopify and its payment providers, and may link to third-party websites. We do not control those services or sites and are not responsible for their content, practices, or availability. Your use of them is governed by their own terms.

15. Disclaimer of warranties

Except where prohibited by law, the Site and everything on it are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that product descriptions, colors, or other content are accurate or complete.

Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you. Nothing here limits any non-waivable rights you have under consumer protection law.

16. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from your use of the Site or any product purchased from it, whether based in contract, tort, or any other theory, even if we have been advised of the possibility.

To the fullest extent permitted by law, our total liability for any claim relating to the Site or a product will not exceed the greater of the amount you paid for the product giving rise to the claim, or fifty U.S. dollars ($50).

Nothing in these Terms excludes or limits liability for fraud, personal injury or death caused by negligence, or anything else that cannot lawfully be limited.

17. Indemnification

You agree to indemnify and hold harmless Foxtrot Mercantile and its owners from any claim, loss, liability, or expense, including reasonable legal fees, arising from your breach of these Terms, your misuse of the Site, or any content you submit to us.

18. Events outside our control

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including carrier delays, supply shortages, equipment failure, power or internet outages, natural disasters, labor disputes, and government action.

19. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Subject to Section 20, you and we agree to the exclusive jurisdiction of the state and federal courts located in Ventura County, California.

20. Resolving disputes

Talk to us first. If you have a problem, email foxtrotmercantile@gmail.com before starting any formal proceeding. Nearly everything is resolved this way, and we would rather fix it than argue about it. Please give us 30 days to respond.

21. General

Severability. If any provision of these Terms is held unenforceable, the rest remain in full effect.

No waiver. Our failure to enforce a provision is not a waiver of it.

Assignment. You may not assign these Terms. We may assign them in connection with a sale or transfer of our business.

Entire agreement. These Terms, together with our Privacy, Refund, and Shipping Policies, are the entire agreement between you and us regarding the Site.

Changes. We may update these Terms at any time by posting a revised version with a new "Last updated" date. Changes apply to orders placed after they are posted. Your continued use of the Site means you accept the current version.
